1. Who sells it
Licenses for Luma for Mac are sold by Polar Software, Inc. (3500 South DuPont Highway, Dover, DE 19901, USA) as the reseller (merchant of record). Your purchase contract is with Polar. Polar handles payment, invoicing and sales tax, and you receive your invoice from Polar by email. Polar's terms also apply to the purchase: polar.sh/legal/terms
The developer of Luma and licensor is the provider named in the legal notice. I'm happy to answer questions about the app, the license and refunds directly: hello@suenavus.com
2. Trial
From the first launch, you can use Luma for Mac free and without restrictions for 30 days. You don't need an account and you don't enter any payment details.
When the trial ends, Luma stops playing music until you activate a license. Your library, playlists and settings are kept.
3. Price, payment and updates
A license costs a one-time €39 including statutory VAT. Depending on your country, Polar shows the amount in your currency and with the tax that applies there. There is no subscription and there are no in-app purchases.
The license is valid for life. All future updates of Luma for Mac are included.
4. Refunds
Within 14 days of your purchase you get the full price back, no reason needed. Email hello@suenavus.com or Polar's support and include the email address you bought with. The refund is made through Polar to your original payment method.
With the refund, your license key is revoked. Luma for Mac then stops playing music, but your library is kept.
Even after the 14 days, please get in touch if something doesn't work. Your statutory rights, in particular any statutory right of withdrawal towards Polar, are not affected by this policy.
5. License terms
5.1 Right of use
With your purchase you receive a simple, perpetual and non-transferable right to use Luma for Mac on up to three Macs that you use yourself. You may use Luma privately and professionally.
5.2 Activation
You activate the license in Luma with your license key. Each activation takes one of the three seats. You free a seat with "Remove from this Mac" in Luma or in Polar's customer portal. What data is transferred is described in the app privacy policy.
5.3 Not allowed
- passing on, selling or publishing the license key,
- bypassing the license check or modifying the app so that it runs without a license,
- decompiling or reverse engineering Luma, except where the law expressly allows it.
You're welcome to pass on the unmodified download from this website. Anyone who keeps using Luma after the trial needs their own license.
5.4 Rights to the software
All rights to Luma remain with the provider. Luma for Mac includes the open-source component Sparkle (for updates), which is covered by its own license.
5.5 Revoking a license
A license key can be revoked if the purchase is refunded or the payment is charged back, or if the key was passed on contrary to section 5.3.
6. Promise in case Luma for Mac is discontinued
If Luma for Mac can ever no longer be continued, for economic reasons for example, the app becomes free and open source. So what you bought stays usable.
7. Luma Transfer
Luma Transfer is free and needs no license. You may use the app privately and professionally on any number of Macs. Section 5.3 (modifying and reverse engineering) and section 9 apply accordingly.
8. Luma for iPhone and iPad
Luma for iPhone and iPad is a free download on the App Store. Apple's standard license agreement applies: www.apple.com/legal/internet-services/itunes/dev/stdeula/ Purchases and refunds on the App Store go through Apple: reportaproblem.apple.com
The license for Luma for Mac covers only the Mac app, not Luma for iPhone and iPad.
9. Warranty and liability
The statutory warranty rights apply.
I am liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. For slight negligence I am only liable if an essential obligation is breached on whose fulfillment you may rely, and then limited to the typical, foreseeable damage.
Luma only changes your music files when you edit tags yourself, and moves deleted files to the Trash. Still, back up your music collection regularly, like all important data.
10. Final provisions
German law applies. If you are a consumer, mandatory consumer protection provisions of the country you live in remain unaffected.
If these terms change, the version that was on this page at the time of your purchase applies to your purchase.
